Article 44 Role and Powers of the District Chairman and the Mayor of the Local Government

  1. He is the Chairman of the District Council and the Mayor (Mayer) of the local government and the chairman of the central government bodies at the district level.
  1. To fulfill the roles and powers outlined in paragraph 1 of this article, the Chairman: A. Presides over the District Council, the Executive Committee, and the Standing Committee.
  1. Manages the heads and staff of the central government bodies at the district level and presides over their meetings.
  2. Manages the staff of the local government and oversees their job assignments.
  3. Is the chairman of the district-level security agencies.
  4. Oversees the development plans of the district and those of the local government. F. Implements the decisions of the district’s local council.
  5. Liaises with the District Council, the central government bodies at the district level, and the regional administration.
  6. Supervises various activities within the district.
  7. Prepares the district’s development plans and those of the local government, and subsequently submits them to the District Council for approval.
  8. Participates in the implementation of the district’s development plans.
  9. Participates in ensuring and maintaining the security of the district.
  10. Manages the staff of the district offices and the local government.
  11. Participates in organizing the meetings of the District Council, the executive committee, and the standing committee.
  12. Participates in enhancing the district’s economic growth.
  13. Ensures that the district’s budget is used in accordance with the plan and the law.
  14. Signs agreements on behalf of the local government.
  15. Approves and also signs expenditure vouchers and receipts.
  16. Proposes the local government’s budget for the district.
  17. Proposes and presents to the District Council the plans and by-laws.
  18. Speaks on behalf of the Council and reports on district matters.
  19. Participates in preparing reports for the council, the central government bodies of the district, and the local government.
  20. Is a member of the Regional Development Council.
  21. Ensures the fulfillment of the obligations set by this law and other national laws.

 

Article 45 Role of the Deputy Mayor

  1. In any situation where the Mayor resigns, is dismissed (removed from office), is absent, incapacitated, or deceased, the Deputy Mayor assumes his duties.
  2. It is not permissible for the Mayor to delegate any part of his duties and powers to anyone other than the Deputy Mayor, especially in situations outlined in the first paragraph of this article.
  3. The Deputy Mayor handles any other tasks assigned to him by the Mayor.

Article 49 Appointment and Dismissal of the Executive Secretary

  1. The Executive Secretary of the local governments is an official from the Ministry of Interior Affairs. His appointment and dismissal are under the jurisdiction of the Minister of Interior Affairs.
  2. The requirements for the Executive Secretary of the Local Governments include
  1. He must be a citizen of Somaliland.
  2. His age must not be less than 35 years.
  3. The Executive Secretary of the “A” grade districts must have a

university-level education and at least 4 years of work

experience related to administration and accounting.

  1. The Executive Secretary of the “B & C” grade districts must

have a Diploma level education or its equivalent with no less

than 5 years of experience.

  1. e) He must not have been convicted by a court of law in the last

years.

  1. f) He must possess qualities of responsibility, good morals,

integrity,   and be honest and dedicated.

  1. The Executive Secretary of the districts can be dismissed from his position:
  1. If he resigns and his resignation is accepted,
  2. If he cannot perform his duties due to health reasons or mental illness as confirmed by a medical committee registered with the Ministry of Health.
  • If he is accused of a punishable crime with imprisonment of three (3) years or more.
  1. If he cannot perform his duties due to lack of competence or if he commits misconduct, mistakes, corruption, nepotism, tribalism, etc. The members of the district council with a two-thirds majority vote approve this matter and submit it to the Minister of the Ministry of Interior Affairs.
  1. When the position of the secretary is vacated or if the position becomes vacant, in accordance with paragraph 1 of this article, the Minister of the Ministry of Interior Affairs is obliged to complete the appointment of the new Secretary within 14 days.
  2. During the appointment of the new secretary, the tasks are temporarily carried out by the Manager of the Administration Department of the local district.

 

Article 42 Role of the Executive Committee of the District Council

 

The role of the Executive Committee of the District Council includes:

  1. Implementing the daily administrative tasks of the District.
  2. Monitoring and ensuring the smooth progress of district activities.
  3. Implementing, following up, and ensuring the decisions of the District Council are carried out.
  4. Implementing regulations, laws, decisions, and directives emanating from the standing committee of the District Council and the government.
  5. Preparing and implementing the budget.
  6. Overseeing the implementation and monitoring of development projects.
  7. Preparing operational reports on activities between their sessions and presenting them to the standing committee.
  8. Presenting urgent directives from the government to the standing committee that cannot wait for the council’s session.
  9. The powers of the District’s Executive Committee include:
  1. Managing expenditures.
  2. Managing and allocating land positions in cities in accordance with the city’s master plan, and in compliance with the urban land management law, in line with Law No. 17/2001.
  • Proposing tax collection, increase, reduction, valuation, and issuing licenses for services they are authorized to provide, and submitting them to the Ministry of Interior Affairs for the House of Representatives’ approval.
  1. They can enter into agreements with any party that has mutual interests at the district level, in accordance with national laws.
  2. They can engage and transact with any company, individual, or any other entity related to their duties, following the national procurement law.
  3. They can represent any party or activity that is part of the local government.
  • They can provide staff, equipment, services, and housing whenever needed for the general benefit, with the approval of the standing committee and the Minister of Interior Affairs, notifying the general treasury.
  1. Drafting and presenting to the council the writing of the local government staff, both permanent and temporary.
  2. Approving the leave of members of the District Council.
